That is a good idea, Amy.
I emailed FYE this morning to let them know that they have managed to anger an entire fan base and that we all feel this is a scam. I asked them to do something about it immediately or risk the ramifications.
I just thought it would be good for them to know that many of us are communicating with one another about this. I'll keep you updated.

chitowngirl - let us know what you get as a response.
I was so upset the other morning that I typed up a scathing e-mail, but then decided to wait. But I'm pretty livid right now.
Dozens of us from all over the US have not gotten it. Many of us have supposedly been sent 2. So far they are 0/2 on every single one of us. Not the way to treat the customer!

WOW!! I ordered mine later. They couldn't confirm that they still had them... but they couldn't tell me I would NOT get it.
I'm so disgusted that the ones that ordered first thing have still not gotten thier photos. My order was for an additional cd... figured it helped the band so it wasn't a big deal.

Well, I have received TWO emails from FYE. The first one was rather generic and I think it's computer generated. Last night I received another stating that they are still looking into the situation.

ARGH!!! I can't even describe how upset I am. I think someone should inform them that they still have the offer for the 8x10 up at the website! That just proves what a lie this has been from the get go. They now admittedly know that they have no more photos, and still haven't taken down the info on the 8x10. I will go ahead and write them despite knowing what their response will be. I have sent in my dispute to the credit card. Discover Card has a form right on its website. I'll let you know what response I get from the credit card company. Also I think that someone in the band's organization should know how badly this company jerked us around. Obviously this is not the appropriate time. But at some point they really should be informed.

No kidding, I bought like 5 copies and really had no need to buy any from fye, but the photo. As I said in my letter to them I ordered 3 days after the cd was released so you can't tell me they had run out yet. And NO ONE, not one single person has come on here and said they got one. So where did these photos go if we didn't get them, since we know we are some of their biggest fans? I can assure you I will never buy anything from fye again and I will certainly discourage anyone I even hear mention their name. I do plan to write them one more time to assure them it will give me great pleasure to make sure others know the way they operate. Sharon

I bought about a dozen copies of the album. The ONLY reason I bought one from FYE was for the photo. I am going to file a complaint with the Better Business Bureau today. Their website is www.bbb.com. They have an area for e-commerce.

Sheesh. What a hassle.
Anyway, here is the response I got from Discover card.
"Thank you for your message regarding this disputed charge. As requested, I am investigating the charge from FYE.com. At the same time, I have placed a temporary credit on your Discover Card Account for $13.75, which will remain on your Account until the issue is resolved.
It usually takes three to four weeks for an investigation to be completed. Once we receive additional information we will keep you informed via printed mail. "
It's actually pretty promising. I didn't know what to expect. Of course, a refund isn't what I really want but at the same time I don't want FYE to get a dime.
Chitowngirl - Excellent idea! I will write the BBB today.

Writing the Better Business Bureau is an excellent tool. They helped me when I had hospital bills with my foot incident. I'd met my insurance out-of-pocket maximum ($5,000), but the hospital continued to bill me. After not paying the bills and repeated calls as to WHY I wasn't paying the bills, they turned me over to a collection agency. I was beyond livid. I contacted the BBB and within 48 hours the hospital had magically erased the charges!

I was at the BBB's site and tried to fill out a form. I couldn't find fye.com listed. I saw some stand alone FYE stores listed. I also tried searching using the 800 number on my credit card statement with no luck.
I couldnt' find the receipt that came with the shipment that would have their address on there.
Have any of you had luck filing a complaint? Let me know.

Okay, I finally completed my complaint with the bbb.com this morning. There are a lot of steps involved, but it is worth it. First, before you start, make sure you have your order number, order date and any and all dates that you emailed or contacted FYE.com about the photo. You can log onto your account at FYE.com to find the order date and order number if you don't have it. Next, go to bbb.com, click on e-commerce (left hand side). Then go to For Consumers (at the top) You can search for FYE.com, although you won't find it Go to File a Complaint (left hand side) There you can do another company search - select website and type in FYE.com You will get a Kentucky address for the company and your complaint will be forwarded to bbb.com in Kentucky Then you have to fill out the entire complaint. That part will take you 10 minutes or less. I really it is worth taking to the time to do this. This company scammed all of us in the name of MC&LH. I certainly hope there aren't fans out there who will get angry with the band because of this stupid, scamming company. GO GET 'EM GIRLS!! PM me with any questions that you have.

question... I see that Dino responds to threads at lovehammers.com board and I'm wondering if we should present this issue to him? It really sounds like FYE is being dishonest... but we have seen the photos of the guys signing photos so is there a slim chance people got the photos and not one of them posts here?? I haven't noticed a thread like this at the other board (doesn't me it doesn't exsist... I could be blind to it).
I'm just asking an innocent question here. But you better believe that I am WAY pissed that the offer was still posted when I bought the cd... and the customer service wouldn't tell me they were out of photos!!!

donnaduran - that is certainly possible, but in my mind the numbers do not add up.
Everyone who posted here from different states have all been told that they've been sent two. The post office is not perfect, but do you really think that every single one of the photos promised to us just got lost in the mail? It's more likely that they just were never sent. Plus the fact that they've known for days that they're out of 8x10s and still haven't taken down that info on the CD page just shows to me that they're just not honest. JMO - of course.
I'm not really sure who the right person is to contact - LH-wise.
